Article 1 – Definitions

In these terms and conditions, the following definitions apply:

1. SHOPPEDBYSHARBEL: the company that offers products and services through its webshop and other sales channels.

2. Customer: any natural or legal person who places an order with SHOPPEDBYSHARBEL.

3. Consumer: a natural person who is acting for purposes which are outside his trade, business, craft or profession.

4. Product: any product offered by SHOPPEDBYSHARBEL, including clothing, sneakers, shoes, accessories, and other fashion products.

5. Order: a purchase placed by the customer through SHOPPEDBYSHARBEL’s webshop or another sales channel.

6. Agreement: the agreement between SHOPPEDBYSHARBEL and the customer that arises after an order has been placed and accepted.

Article 2 – Applicability

1. These terms and conditions apply to all offers, orders, agreements, and deliveries of products and services by SHOPPEDBYSHARBEL.

2. By placing an order, the customer declares to have read and agreed to these terms and conditions.

3. Deviations from these terms and conditions are only valid if confirmed in writing by SHOPPEDBYSHARBEL.

4. If a provision in these terms and conditions proves to be invalid or voidable, the remaining provisions will remain in full force and effect.

5. Mandatory legal provisions, including consumer law, always remain applicable.

Article 4 – Independent Reseller

1. SHOPPEDBYSHARBEL operates as an independent reseller of original brand products.

2. SHOPPEDBYSHARBEL is not affiliated with, sponsored by, officially authorized by, or part of the brands whose products are offered, unless explicitly stated otherwise.

3. Brand names, logos, product names, and model designations are used solely for the identification and description of the products offered.

4. All brand rights remain with the respective rights holders.

Article 5 – Offer and Product Information

1. SHOPPEDBYSHARBEL strives to display product information, photos, prices, sizes, colors, and other characteristics as accurately as possible.

2. Images are for illustration purposes. Minor differences between an image and the actual product delivered may occur.

3. Depending on release, production year, production region, or distribution channel, differences may occur in, for example, packaging, labels, accessories, or execution.

4. Such normal differences do not automatically mean that a product is not authentic.

5. Obvious errors, mistakes, or inaccuracies in an offer do not bind SHOPPEDBYSHARBEL.

6. Products are offered while stocks last.

7. The main product characteristics, price, availability, and expected delivery time will be clearly communicated to the customer before placing the order.

Article 6 – Authenticity

1. SHOPPEDBYSHARBEL sells products offered as authentic brand products.

2. Products from our own stock are checked for authenticity where reasonably possible before being offered or shipped.

3. For products sourced specifically for a customer, SHOPPEDBYSHARBEL is responsible for the authenticity of the product delivered to the customer.

4. If an external authentication service is used, this check constitutes an additional verification and not an official certification on behalf of the relevant brand.

5. If a delivered product demonstrably proves not to be authentic, SHOPPEDBYSHARBEL will offer an appropriate solution in accordance with the legal rights of the consumer.

Article 7 – Origin and Resale

1. SHOPPEDBYSHARBEL strives to obtain products through legitimate sales, sourcing, and distribution channels.

2. Products may originate from various sales and distribution channels.

3. Offering a product does not mean that SHOPPEDBYSHARBEL is an official dealer, distributor, agent, or partner of the relevant brand.

4. The sale of original brand products by SHOPPEDBYSHARBEL takes place as independent resale, to the extent permitted by law.

Article 8 – Conclusion of the Agreement

1. The agreement is concluded once the customer places an order and SHOPPEDBYSHARBEL accepts this order.

2. After placing an order, the customer will receive an electronic order confirmation.

3. SHOPPEDBYSHARBEL reserves the right to refuse or cancel an order if there is a reasonable reason to do so.

4. This may include cases of an obvious pricing error, stock error, technical error, fraud, or other misuse.

5. If an order cannot be fulfilled, the customer will be informed as soon as possible, and any amount already paid will be refunded.

Article 9 – Prices

1. All prices are displayed in euros.

2. Applicable VAT will be charged in accordance with legal regulations.

3. The website clearly indicates whether the stated price includes VAT.

4. Any shipping costs will be clearly displayed to the customer before completing the order.

5. SHOPPEDBYSHARBEL reserves the right to change prices.

6. A price change does not affect an already concluded agreement.

7. In the event of an obvious pricing error, SHOPPEDBYSHARBEL reserves the right to cancel the order and fully refund the amount already paid.

Article 10 – Payment

1. Payment must be made using the payment methods offered during the ordering process.

2. An order will be processed after payment has been successfully received, unless otherwise agreed in writing.

3. If a payment is not made or not made on time, SHOPPEDBYSHARBEL is entitled to suspend or cancel the order, to the extent permitted by law.

4. In case of a reasonable suspicion of fraud, misuse, or unauthorized use of a payment method, SHOPPEDBYSHARBEL may request additional verification.

Article 11 – Availability and Delivery Times

1. SHOPPEDBYSHARBEL offers products as in stock or on request.

2. Products offered as in stock have an expected delivery time of 1–2 business days.

3. Products offered on request are purchased specifically for the customer after ordering. These have an expected delivery time of 9–14 business days.

4. The relevant availability and expected delivery time will be clearly displayed to the customer before placing the order.

5. The stated delivery times are expected delivery times, unless a fixed delivery period has been explicitly agreed upon in writing.

6. In exceptional circumstances, delays may occur, for example due to a supplier, carrier, or other circumstances beyond SHOPPEDBYSHARBEL's reasonable control.

7. If an order cannot be delivered within the specified period, the customer will be informed as soon as possible.

8. If delivery is no longer possible, the amount already paid will be refunded in accordance with applicable legal rules.

Article 12 – Sourcing and Products Purchased on Request

1. For products offered on request, SHOPPEDBYSHARBEL purchases the product specifically for the customer after the order is placed.

2. The expected delivery time for a product on request is 9–14 business days.

3. The delivery time may depend on availability from external suppliers.

4. If a product unexpectedly proves to be unavailable after ordering, the customer will be informed as soon as possible.

5. If the order cannot be fulfilled as a result, the amount already paid will be refunded.

6. If an expected delivery time is significantly exceeded, the legal rights of the consumer will be respected.

Article 13 – Delivery and Shipping

1. Delivery takes place at the address specified by the customer during the ordering process.

2. For products that are in stock, an expected delivery time of 1–2 business days applies.

3. For products ordered on request, an expected delivery time of 9–14 business days applies.

4. As soon as the order has been handed over to the carrier, the customer will receive a track & trace code if available.

5. For consumers, the risk of the product passes at the moment the consumer or a third party designated by them actually receives the product.

6. SHOPPEDBYSHARBEL will make reasonable efforts to resolve delays or problems during transport.

7. The legal rights of consumers remain fully in force.

Article 14 – Right of Withdrawal for Consumers

1. A consumer generally has the legal right to withdraw from the agreement within 14 days without giving any reason for an online purchase.

2. The cooling-off period begins on the day after the consumer, or a third party designated by the consumer, has received the product.

3. The consumer can withdraw from the agreement within this period by clearly informing SHOPPEDBYSHARBEL of this.

4. The consumer does not have to give a reason for the withdrawal.

5. The consumer can use the model withdrawal form but is not obliged to do so.

6. SHOPPEDBYSHARBEL also offers the legally required online option for withdrawing from an online purchase.

7. After withdrawal, the consumer must return the product no later than 14 days.

8. The direct costs of returning are for the account of the consumer, unless SHOPPEDBYSHARBEL indicates otherwise or the law dictates otherwise.

Article 15 – Refund after Withdrawal

1. In the event of a valid withdrawal, SHOPPEDBYSHARBEL will refund all payments received from the consumer for the relevant order.

2. If the entire order is returned, the costs of the original standard delivery will also be refunded.

3. If the consumer has chosen a more expensive shipping method than the cheapest standard delivery, only the amount of the cheapest standard delivery will be refunded.

4. SHOPPEDBYSHARBEL will refund using the same payment method used for the original payment, unless the consumer explicitly agrees to a different payment method.

5. SHOPPEDBYSHARBEL may withhold reimbursement until the product has been received back or until the consumer demonstrates that the product has been returned, whichever occurs first.

6. SHOPPEDBYSHARBEL will refund the due amount within the statutory period at the latest.

Article 16 – Returns and Condition of Products

1. During the cooling-off period, the consumer may inspect the product to the extent necessary to determine its nature, characteristics, and functioning.

2. The product must be handled with care and, as far as reasonably possible, returned complete.

3. If a product is used beyond what is necessary for inspection, this may result in a decrease in value.

4. SHOPPEDBYSHARBEL may charge for this decrease in value to the extent permitted by law.

5. The product must not be unnecessarily worn, washed, damaged, or used beyond what is necessary to inspect the product.

6. The absence of original packaging does not automatically invalidate the legal right of withdrawal.

Article 17 – Exchanges

1. Exchanging is not the same as the legal right of withdrawal.

2. SHOPPEDBYSHARBEL may, depending on availability, offer an option to exchange a product for a different size or variant.

3. If the desired size or variant is not available, the consumer can make use of the legal right of withdrawal if applicable.

4. The legal right of withdrawal is not limited by any exchange policy.

Article 18 – Exceptions to the Right of Withdrawal

1. The legal right of withdrawal does not apply in cases where the law stipulates an exception.

2. If a legal exception applies, this will be clearly communicated to the customer before placing the order.

3. An exception to the right of withdrawal will only be applied to the extent permitted by law.

Article 19 – Warranty and Legal Conformity

1. Consumers are entitled to legal protection when a product does not conform to the agreement.

2. SHOPPEDBYSHARBEL will provide an appropriate solution in accordance with legal regulations in the event of a valid complaint.

3. Depending on the situation, this may include repair, replacement, price reduction, or refund.

4. Any commercial warranty does not limit the consumer's legal rights.

5. Normal wear and tear or damage caused solely by incorrect, careless, or improper use does not automatically fall under a commercial warranty.

Article 20 – Product Condition

1. New products are offered in the condition described on the product page.

2. If a product is used, pre-owned, vintage, or otherwise not new, this will be clearly stated in the product description.

3. Known signs of use, damage, or other specific features will be mentioned in the product description, where relevant.

4. The customer is expected to check the product for any visible defects upon receipt.

Article 21 – Fraud Prevention and Order Verification

1. SHOPPEDBYSHARBEL reserves the right to refuse, cancel, or temporarily suspend an order if there is a reasonable suspicion of fraud, misuse, or unauthorized use of payment methods.

2. SHOPPEDBYSHARBEL may request additional information or verification in such situations.

3. In cases of demonstrable abuse, fraud, or chargeback abuse, SHOPPEDBYSHARBEL may take appropriate measures to the extent permitted by law.

4. This provision does not affect the statutory rights of consumers.

Article 22 – Complaints

1. Complaints about a product or order can be reported via SHOPPEDBYSHARBEL's official email address.

2. The customer must describe the complaint as clearly as possible.

3. If relevant, SHOPPEDBYSHARBEL may request photos, order details, or other information to assess the complaint.

4. SHOPPEDBYSHARBEL strives to address complaints substantively as soon as possible.

5. Submitting a complaint does not limit the consumer's statutory rights.

Article 23 – Business Customers

1. For business customers, different agreements can be made regarding prices, payment, delivery, returns, and warranty.

2. Statutory consumer protection applies insofar as the customer acts as a consumer and the law declares this protection applicable.

3. Business customers must provide correct company, invoice, and contact details.

4. For business agreements, additional written arrangements can be made.

Article 24 – Liability

1. SHOPPEDBYSHARBEL is liable to the extent required by mandatory law.

2. The statutory rights of consumers are not limited by these terms and conditions.

3. SHOPPEDBYSHARBEL is not liable for damage arising solely from incorrect, careless, or improper use of a product, to the extent permitted by law.

4. This provision does not affect statutory product liability and other mandatory legal provisions.

Article 25 – Force Majeure

1. If SHOPPEDBYSHARBEL cannot fulfill an obligation due to circumstances beyond its reasonable control, there may be a case of force majeure.

2. Force majeure may include, but is not limited to: disruptions at carriers, payment providers, suppliers, technical failures, internet outages, government measures, weather conditions, and other circumstances over which SHOPPEDBYSHARBEL has no reasonable control.

3. During a force majeure situation, obligations are suspended to the extent permitted by law.

4. As soon as the force majeure situation has ended, SHOPPEDBYSHARBEL will resume its obligations as soon as possible.

Article 26 – Intellectual Property

1. All texts, photos, logos, designs, images, videos, and other content on the SHOPPEDBYSHARBEL website are the property of SHOPPEDBYSHARBEL or the respective rights holder.

2. It is not permitted to copy, distribute, publish, or commercially use this content without prior written permission.

3. Brand names and logos of third parties remain the property of their respective rights holders.

Article 27 – Privacy

1. SHOPPEDBYSHARBEL processes personal data in accordance with applicable privacy legislation.

2. More information about the processing of personal data can be found in SHOPPEDBYSHARBEL's privacy policy.

3. The privacy policy is separately available on the website.

Article 28 – Amendment of the General Terms and Conditions

1. SHOPPEDBYSHARBEL may amend these general terms and conditions when there is a reasonable reason to do so.

2. For agreements already concluded, the terms and conditions that were applicable at the time the agreement was entered into shall remain in force, unless the law stipulates otherwise.

3. The most current version of the general terms and conditions will be published on the website.

4. Changes will not be used to limit the statutory rights of consumers.

Article 29 – Applicable Law and Disputes

1. Agreements between SHOPPEDBYSHARBEL and the customer are governed by Dutch law.

2. For consumers, they retain the protection afforded to them by mandatory consumer law.

3. Disputes will be submitted to the competent court in accordance with legal rules.
